    You're writing in a rather confusing manner, but if you have your own lawyer, why aren't you getting advice from them?

    A court may consider the ombudsman to be the proper channel at this stage.  That may add to the delay unnecessarily.  The courts service try to minimise  the number of cases going through, hence why mediation is pushed so much.  If there is a system outside the courts, the courts will expect you to use that first.
