Faulty liner in a hottub commercial

Hi has anyone got any help,
I bought two hottubs from Skargards and one of the liner has a defect in it which is like a small hole in the liner, They have fixed it now 3 times but it keeps coming back. I have asked now for it to be replaced and they have said there option is to ship it back abroad to replace the liner. We will be without it for 4 weeks if they do this, I have said this will impact us financially so i would like it replaced on site or a new tub. They have said as we but them for  commercial we are not covered under normal consumer rights . On there website it says two year guarantee. The issue happened and was reported within 7 months of purchase ,  Can anyone give me some advice

Was this a consumer or business purchase? It does make a difference to your legal rights.

This is important, it does sound like the purchase was B2B and OP will need to clarify.

    Welcome to the forum.

Advice is to read the terms and conditions of the warranty.

As you are aware, consumer rights do not apply to B2B contracts.

Retail warranties usually say they do not cover any business use. They almost certainly say they do not cover any consequential loss such as loss of bookings.

You do have rights under the Sale of Goods Act 1979.

So is this commercial or consumer? Guessing given the average home doesn't have two hot tubs it is a business to business arrangement?

Guarantees are on top of consumer rights, if applicable, if you want to claim under the warranty you need to read the terms of the warranty which may be that they go for offsite repair.

    Definitely sounds like B2B.
