To be able to make an unfair dismissal claim you would first have to show that you should have actually be treated as an employee and not as self employed, regardless of what any paperwork / contract says.
It is important to also understand that is is perfectly possible for HMRC to decide that somebody is / should have been an employee for tax purposes but for an employment tribunal to take the opposite view for employment law purposes. Crazy as it may sound, neither is binding on the other!1 -
