Probate - Tenants in Common

My father passed away. My parents owned their house as tenants in common, it is valued at around £250,000. My dad has left his estate to my mother in his Will, he has about £6000 in a personal ISA but nothing else. Do we need to apply for probate?

Additionally, am I correct in my understanding that due to the tenants in common status with the residential property, it will be subject to the nil rate band. Will this affect the residential nil rate on the property when my mother passes away, she has left her estate to myself and my sister.

Unlikely that you will need probate unless the ISA provider needs it.

Assuming they are married then none of his NRB will be used as it is covered by spousal exemption. None of his RNRB will be used either, but it does not look like that will ever be needed as your mother’s estate will be well below £650k.
