TENANTS IN COMMON - DO WE NEED TO CHANGE OUR WILLS

A number of years ago we submitted a form to our solicitor to change ownership of our house to "tenants in common"
We received conformation of this from Land Registry
Do we need to amend our standard "mirror will"
thanks covid

The point of being TIC is that there is usually someone else (other than the spouse) that you want to leave your share of the house to. Your will should reflect who this is

Applying for a form A/joint proprietorship restriction as it’s known is often associated with tenants in common and writing your wills etc
It can stand alone but invariably it goes hand in hand with some form of arrangement re your beneficial interests such as wills or deed ot trust or similar

  • If you still want the survivor to inherit your share absolutly then you don’t need new wills. If you want to pass to someone else and leave the survivor a life interest then you need new wills.
