My husband died several months ago and I have received a cheque from HMRC in respect of his tax.He was receiving the married couples allowance as he was born before the qualifying date, I was born after that date.
Would I be entitled to any of the married couples allowance against my tax or would the cheque issued have taken that into account?
Please forgive my ignorance on this issue and any incorrect phraseology

But Married Couple's Allowance is quite generous so there may be some surplus and this is transferable for the tax year in which he died.
Have you received a calculation showing how the overpayment was arrived at or just a cheque?0 -

I will check tomorrow. I was surprised that there was not an accompanying statement with the cheque but I have not dealt with anything like this before.

You won't be able to apply for any surplus as his spouse but you probably can apply as the Personal Representative/Executor of your late husband.Redcross said:I will check tomorrow. And you will then get any benefit for the current tax year but not any later years. Depending on what surplus (if any) is available it could save you up to £1k in income tax.
You are likely to need to complete form 575 (as the Personal Representative/Executor).0 -
