2 x Parking Charge Notice to Keeper from NCP 8 weeks & 10.5 weeks after date of incident

Hello,


I have read through the newbie thread and although there is an awful lot of information I can’t understand how to appeal or if I have grounds to appeal,


I’ve received 2 ‘Parking Charge Notice to Keeper’ letters through the post today, both from NCP for not paying to park. Both £100 charge, reduced to £60 if paid in 14 days. Both letters are for the same car park but on different dates roughly a week apart. I do use that car park sometimes but honestly cannot remember if I had parked on those dates and if I had forgotten to pay or not.


Given I cannot remember if I did park on the dates that the NCP state in each of these letters I want to appeal due to the amount of time it’s taken to send these letters to me.


If I’m understanding the newbie thread correctly it seems to suggest that I can appeal to these with the below template, but this doesn’t seem to address my reason for appealing - the time lapsed between the date of incident and date of receiving these letters.


Please would someone mind helping advise if I do have grounds to appeal, and if so should I be using the below (or another template) or can I just state in my appeal that the time lapsed between the date of incident and date of receiving these letters is too long, and so invalidates the charges?

Re PCN number: 


I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.


There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.


If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.


If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.



THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE, OR IN THE RELEVANT BOX ON THEIR APPEALS PAGE.


THE DRIVER IS NOT IDENTIFIED.

    Ok thanks for your reply I’ve tried using some of your search terms and have found the below, is this all I need to include?
    Sorry I’ve never received a PCN before and I am trying my best to understand all the language in the newbies (and other) posts but I’m finding it difficult to navigate.

    Incase it’s relevant I did not receive anything on my car physically. They do have photographs in the letters that they have time and date stamped.

    I am appealing as registered keeper and I have seen no evidence of a contravention.


    As your Parking Charge Notice does not comply with the requirements of the Protection of Freedoms Act 2012 (Schedule 4) you are, in law, unable to hold the registered keeper of the vehicle liable for the parking charge. Therefore, I suggest that you contact the driver. As there is no legal requirement placed on the registered keeper to identify the driver, I will not be doing so.


    The matter between us is closed because I've declined your invitation. I require you to cancel the parking charge and remove my personal information from your database.

    Yep, thats the one, fire it off.

    DON'T tick Driver as Coupon-mad says. Select Keeper when it says what your appealing as (or something similar to that wording)

    It has got me thinking though, other than morals, what stops someone from just never paying for parking and always making appeals?!

    Your conscience, good moral stature and the knowledge that it's that selfish tiny minority of thoughtless drivers who have caused and fuelled the rise of this monstrous industry.

    And the fact that not paying the parking fee deprives the landowner usually.  Not the PPC.  None of us have a problem with paying an honest landowner a fair fee to park.
