after sending cca requests by myself and wife in October to PRA regarding Barclaycard credit card account debt if roughly £6000 each.

they initially said it was unenforceable due to not finding statements for mine and the credit agreement for my wife.

yesterday, they posted the agreement bro my wife and 2 years worth of statement from 2020 to 2021 ,to the point where pra bought the debt in late 2021.

we had made payments in the last couple of years reducing the balance, then we stopped when we did cca requests.

pra wrote along with the documents please contact us, so we did.

i complained that they still never stated if it was still unenforceable, they said it is not as they now consider it live again.

i said why didn't you state that, by that point I said how much discount for full and final settlement,( I was being nosey)
they said 10% discount, but if I write in they may consider more.

I said I can't do full and final at mo anyway.

then I said what happens now, they said account on hold for 14 days.

got email today saying they are investigating our complaints why they never updated the status eg enforceable in this letter, and assumed it.

they said they will investigate , it may take 8 weeks and accounts are on hold till complaint resolved.

so overall , it looks like PRA have won and our Barclaycard debt is now repayable, we opened it in 2011 until default in 2021. then pra bought it.


Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

    Could I also suggest that it might be best to make a single thread and stick to that with any questions about your debt/DMP? Not only will it be easier for those able to offer help to keep track of what is going on, it will help you too - as down the line a lot of people find it really motivating to be able to look back on a thread and see how far they have come.

    my point is pra have produced both the agreements and the statements, but they never said it is now went from unenforceable to enforceable 

    they simply said we have now produced all the documents you requested, now contact us to agree payment plan with 14 days, which we did contact them.

    we complained that they never updated the status in their letter.
    which they now  said they will look into  why it was worded like that and place our accounts on hold for another max 8 weeks 

    do we have grounds for our complaints to provide some sort of action, which will benefit us

    I mean there isn't much ammo I have left, is there, they produced the documents eventually.
    but it's the wording in the final letter I'm not happy about.
    if I ignored that letter, then what, cos my argument was it never stated now enforceable 

    it was only when I contacted them, they said your account is no longer unenforceable ,but is back to being "live".so please pay a plan or full amount

    The debt is naturally assumed to be enforceable, its not up to them to state it is so.

    It would only be unenforceable if the required documents were not provided, they now have been, the debt is live again, its as simple as that.

  • If your argument is that they have not told you it is enforceable and therefore you didn’t know, that begs the question of why you asked for the CCA in the first place? (At least, that is how they would counter any complaint I would expect.)

    They've produced the CCA, I think you just have to accept that now, there's no point worrying about anything else.

    yes rob, interesting they offered a 10% discount if settled now, and maybe more if I write to them, they said to me.

    I thought 5% was their norm
    now it's working out how much to offer them per month

  • PRA offered me a 45% discount on a barclaycard debt. It might be higher because I am not working due to health issues. Unfortunately it wasn't enough discount for me to take them up on the offer.

    update,my wife complained today pra as to why the letter never stated debt is now enforceable, they said they won't entertain her complaint.
    yet when I called they put my account on hold and will investigate it for 2 months.

    so someone is trying to fob off wife at pra call centre, this is unacceptable , they can't make different rules for exactly the same problem
