How to get parking company to refund leasing company admin fee?

    mmm, so it seems that unless the Department for Levelling Up acts on this, ppc's can continue to issue meritless pcn's at a cost to the motorist and the vehicle leasing industry with no comeback.

    There's a lot of work going on. I've been involved on the DLUHC's steering group since 2020.  I can't talk about the work but let's see what the actual Impact Assessment and final Public Consultation brings. Expected soon.

    Private parking companies are completely un regulated, the question is can a lease or other company pass on an admin charge generated as a result of the antics of an un regulated company?
    Whats to stop me from contacting the lease company with a spurious charge knowing that an admin charge will be pocketed each time?

    further to the above, Admin fees for passing on information should be a part of normal business costs for which customers should not be expected to ( directly) pay for in separate fees in most cases

    Lets look at "real" parking tickets, issued by your local authority:
     A lot of Local authorities, district councils, county councils and so on have subcontracted enfarcement out to (mates in) private companies
     Working for a private company,. you are not working for the public "good" you will have key performance targets to reach and all of the other such guff that goes along with that, so the pressure will be on to ticket as much as possible for whatever possible, ticket issued - job done target reached, issue ticket first if the ticket  has been ticketed in error then it doesn't matter as they can always appeal it.

     And with official council tickets issued in error the appeal route though it can be  cumbersome and require a few steps/hoops to jump through it is independent and backed up by statutory regulations .
     Someone should not be charged an admin fee regardless of if its £5/£10/£50 or whatever on the back of someone else's error
     Without looking into it further my thoughts would be that these admin fees irrespective of their size may fall foul of various consumer rights/contracts acts - unfair terms in consumer contracts/ consumer rights act  might point things in the right direction.

    Private parking charges just add another heap of stuff to the above as well

    I am aware that the registered keeper can be a separate entity to the vehicle owner. It would simplify matters if the vehicle leasing company allowed me as lessee to be the registered keeper until I return the car to them.

    You cannot be the registered keeper without being registered with the DVLA. This may or may not be agreeable with the lease company, who may or may not be the vehicle owner.
    The lessee however is by default, the (day to day) keeper.

    I used to deal with a very large leasing company I had 19 staff vehicles to administer, they basically used admin fees as another way of bumping up their income, very few businesses add on extra fees for doing business but car hire/lease companies use every little add on they can.
    I used to flatly refuse to pay them, (my company the largest in its field in the world wanted to make the deductions through salary adjustments) I made so much hassle that their staffing time to deal with me far outweighed the admin costs they were trying to claw back, and they didn't want to upset one of their biggest customers.
  • The lessee is known as the "hirer". As the lessee you are the day to day keeper but if you want to know how to be referred when it comes to legal issues, you are the "hirer".

    Hence, if you receive a PCN, you should not do anything until you receive a "Notice to Hirer" (NtH) which should be issued after the registered keeper (RK) has received the Notice to Keeper (NtK) and transferred liability to the "hirer" (lessee).
