Who is responsible for return postage to China

I ordered a Dashcam having read a recommendation on a *co.uk website.  I quickly found out the site was very suspicious having discovered it only had 1 star ratings on the TrustPilot review site.  I quickly cancelled the order within 60 minutes to the websites UK email address. I also informed Klarna who were the payment route.   I did not receive confirmation of the order cancellation.  More than 12 hours later I received a tracking number.  I sent another email to the seller stating I had cancelled, to which they did not respond again.   The Dashcam subsequently arrived, so I requested a prepaid returns label for the UK return address printed on the package.  A week later the seller informed me I had to return it to China, for which I requested a returns prepaid label.
Today they provided an addres for which I have to pay postage, custom duties and clearance fees.  Who is responsible for postage costs, and if it is me why can't I return to the UK return address.  I have not opened the package.

    A link to the website is always helpful, or at least its name given your a new member so cannot post actual links. 

    You ultimately need to be pragmatic, it's an overseas company in a legal jurisdiction that is hard to enforce action in as a foreigner. So even if you did have "rights" etc actually getting any response from the company will be difficult. 

    Generally if you order from a company in China your contract will be under Chinese law and I've no idea what Chinese law says about right to return orders for change of mind for overseas customers. In many of these websites they often say it's "US" law that applies, which isn't a legal jurisdiction but is somewhere with minimal protections. Even if was under "UK" law (that equally doesn't exist) there still isn't an automatic right for a free return for change of mind. 

    Given you paid by Klarna I would be speaking to them before doing anything, I am guessing its a short term 3/4 payment agreement so not regulated by the CCA and so no S75 rights hence need to see what they'll do. Had you paid by card instead of Klarna you could have done a chargeback but only after you had returned it to the company following their returns process at your own expense. It therefore somewhat comes down to the relative costs of the item and postage etc. 
  • Technically the seller is, but enforcing your rights will be difficult if the retailer is based in China and operating under Chinese consumer laws.  What's the value of the item?  You may be better off retaining it and writing the money off.

    The odd ones to me are the ones that check after buying but before realising they made a mistake

    It's like those people that decide to buy insurance or a TV and only after buying then decide to shop around and see if it could have been cheaper.

    Anybody can have a .co.uk website. It doesn''t mean they are a UK compnay.

    The goods will be shipped in  to a  distribution centre in UK , which will be a warehouse that sends out orders.

    They will have no ability to accept or deal with return orders.

    Many sites, even in the UK, now require the purchaser to pay return postage in the event of simply changing their mind.
