Probate

My sister died in November. She left a will and left everything to her daughter (my niece). I'm the executor and I've had probate granted. I just need some clarification as I feel I'm confusing myself.

The property has a mortgage on it so my niece is getting a mortgage to cover the existing mortgage and some credit card debt. Do I need to send AS1 and AP1 plus an original copy of the probate now to transfer the property to her so she can then get the mortgage to pay everything off? Also do I need to send an ID1 for her? And I have one original Grant of Probate, is it ok to send this in or should I get another copy?

    Our online guidance explains how you can transfer the property as the executor to her as the beneficiary. You’ll both need your identity verified. You don’t need to send us the original probate. A certified copy will do. 


    If there’s a mortgage in play do speak to the lender involved first. If you need to deal with them re transferring the mortgage or repaying it then they’re likely to insist you use a conveyancer
