Flashpark are VCS (Vehicle Control Solutions) of London, but not the VCS (Vehicle Control Services) of Sheffield. Often mixed up.

One provides no service, the other no solution! 😄
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Obviously more cash to be made in parking scams than Greek Food :D

  • There may be other grounds but you have redacted the location and the time of reporting.  This can  all be fleshed out at the POPLA stage if you have by then posted a less eccentrically redacted copy.

This is what I wrote in my first post

I an still chuckling about the upside-down photo!  How unprofessional from an industry which is trying to convince the Government they are providing a service to the public.

This is similar to "driver left site" PCN and should be easier to appeal but as the OP has already appealed I am not sure what to do. The parking company needs to proof the driver of the vehicle or any of its passengers did not actually visit the retail outlet owning the parking space. So unless, they have a video of the driver/passengers covering the whole time they spent on the premises (highly unlikely), then they will fail to win this case in court if defended (very important as they can win by default if not defended).

If I was in the OP's shoes, I will appeal along the following lines:
    1. No evidence of the driver/passenger not visiting the retail outlet, just images of the car parked on site and the sign.

    2. No clear definition of the boundary between the retail outlets on the same site.

    3. No attempt by the Warden to advise in order to mitigate losses.

Even if there is no avenue to appeal, I will send this to the parking company and add that unless they can produce evidence (video recording of the driver and all passengers for the during of the parking), they will be better to drop the PCN now rather than risk losing later if they can't provide this evidence.

I had a similar case with UKPC last year and the appeal above got them to cancel the PCN.

    Best of luck.

Hi All it’s now been over 2 weeks now since the pay by date on the parking charge. I have heard nothing as regards the 2 letter's I sent in or what they are doing next. So with that in mind
how long do they have to reply or move to next stage
as they haven’t acknowledged my letters the next obvious thing would be to either drop it
or threaten debt collection/ court action if the latter what options would I have

You'll understand each stage after reading the NEWBIES thread.

Post 2 deals with court stage.

Post 3 with the farce 'appeals' services.

Post 4 deals with ignoring DRA threatograms.
