Help please!
I received a letter today from debt recovery plus for a parking fine stating I was “not parked correctly within the markings of the bay or space”. This is the first letter I’ve received saying I owe a fine of £170!
I would have been parked in a parent and child space. I’m really worried and have been looking online and seen mixed reviews, will this escalate to court?

    Please read the 4th post of the NEWBIES thread.  And ask yourself why you got no PCN in the post.  Your V5C address isn't up to date, is it? That's the commonest issue after people move house.

    And after you've checked your V5C if correct address is recorded please support this.
    So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes.

    PPCs always claim discounted rate/full rate pcns/court claim letters were sent though they offer no evidence to prove this. Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP.

    I am new to the forum but I have read through the newbies thread and other pages to familiarise myself with the content. I too have received correspondence regarding a PCN relating to a Smart Parking Ltd car park. I did not get a windscreen ticket as the car park was ANPR controlled and I did also not receive a notice to keeper. I paid for the parking charge at the time of parking that was calculated by the parking machine and it appears I paid for 1hr. The first correspondence I received was from Debt Recovery Plus some 3 months after the alleged incident took place, thus resulting in me being outside of the 28 day period to appeal. I have tried to appeal via the Smart Parking Ltd portal twice to explain the situation but they have not answered any of my queries and have stated I am out of the 28 day appeal period, but to no fault of my own. They have not provided me with a POPLA verification code despite me asking twice. Can I assume from the comment above, that the private parking company does not have to provide proof of postage or receipt regarding a notice to keeper? Therefore rendering the process vulnerable to their manipulation ie PPC doesn't send a notice to keeper, therefore keeper cannot appeal within 28 days.

    My second query is, can I still appeal via POPLA or the Independent Appeals Service at this stage/timeframe from the incident?

    My third query is just to clarify some of the information on the other threads as I was a little unclear. If Smart Parking opt to take me to small claims court and I lose, what costs will I have to pay for? I assume the £100 for smart parking ltd plus court fees and solicitor fees, what sort of figure do these normally come to? Do you also have to pay the Debt Recovery Plus figure on top of this?

    I would greatly appreciate your wisdom and clarification re this. Thanks

    You say "I too have received correspondence  regarding a PCN relating to a Smart Parking Ltd", yet Smart Parking have not previously been mentioned in this thread.

    Can I suggest that to avoid confusion you start a new thread about your entirely different issues?

    The reason I posted within this thread related to my receipt of a PCN and the previous comment from Nellymoser on the 16/2/24 relating to whether the Private Parking Company has to/does not have to provide proof of postage. I was merely stating which Private Parking Company this related to in case this was relevant. Are you able to offer support on the above query?

    Hi, any update at all? I have also received one :(  and unsure If I should contact them to say I wont be paying it
