Problem with Car

I bought a car from a dealer for £23471.00 on 02/08/2023.

The vehicle  had a fault the day i picked it up . I was told it would be repaired. It has been back in 4 times still got the same fault . Now the car is in limp mode and undrivable. I asked about a refund back last year, was told because the car was not fixed they would not refund my money. When they said it was fixed , which it was not . They offered me £10.000 less than i paid. I have had 3 diagnostic checks all saying its the same fault . The dealer said they sorted last December. But 3 weeks ago i got the same issue again , customer service, said they are waiting for paperwork from the branch , then it will be passed to someone else to look at.. Today after a long chat to their customer service . It has been booked in to be checked. They said a new DPF was fitted in December and because of my driving style it is now full and they will not sort anything out.. Do i still have consumer rights because its an on going issue..

    Yes, you still have your consumer rights.

    Could you tell us more about the car? Make and model, age, mileage, condition, that sort of thing?

    I assume it is diesel and 'it's the same fault, the same issue' means that it is OK except for issues to do with the DPF?
    DPF issues are very often linked to driving style. What mileage have you done since you bought it six months ago? What kind of journeys do you do?

    You say they offered you ten pounds less than you paid, which you refused. Do you mean a hundred pounds less (£100.00)?

    What is your driving regime?

    Do you only do short journeys (as in less than 20 minutes)? How many miles have you done since this DPF replacement in December?

    Mileage is not relevant, you will get people who tell you that you need to do at least so many miles and on higher speed roads. That is not true and they do not know what they are talking about, unless the car is 15+ years old which a £20k+ price does not suggest.

    Modern diesels can re-generate the DPF at low speeds, even in stop start traffic, if the car is running for long enough. You will know it happens as the revs will rise slightly.

    These issues are more often caused by a faulty sensor not allowing the car to start the regen process which then does fill up the DPF.

  • Its a Mercedes e220D. I paid cash for the car . It was £23,471. I was offered £13,500 by the dealer. I drive 40 minutes to work each way and i use dual cariageways for 1/2 the journey  , and go on the motorway at least once per week .
  • The car has done 62,000 miles. I have only done 6000 miles since i had the car. The car is in really good condition . Yes only the DPF fault. Had another diagnostic today .. same fault DPF blocked..

    Then your driving regime is not an issue at all so don't let them fob you off there. That engine will regenerate in traffic, let alone on an open road (I know this from experience having had the more powerful version of the same engine in an E250 Cabriolet.

    I had the same issue with it not performing a regen, it was throwing up error codes but not the warning light until much later. Reading the codes showed 2 different sensors had failed and needed replacing. Swapped those and never had a problem in the couple of years that followed before I sold it.
