Looking at my UK 2020/21 tax return, completed by an accountant familiar with both jurisdictions
I made a type earlier. It is a period from 6th April 2020 to 30th June 2020 where I was paid in GBP and PAYE was deducted. My 2020/21 tax return is the correct one and I can see that HMRC have missed that incomes and PAYE off of their calculation.

Thank you to those who took the time to reply. I'm not sure any of you can help or give any advice though. Quite simply I paid PAYE tax to HMRC for a tax year where I did not so much as set foot in the UK. The ATO has taxed that same income because I was an Australian tax resident, and only an Australian tax resident in the Australian tax year from 1st July 2020 to 30th June 2021.On HMRC's calculation they have completely missed out the employment income and PAYE tax. It is not any deeper than that. All I want is for HMRC to recalculate using all the information they were provided on my paper return.I will wait for HMRC's response to my complaint and take it from there.0

As I’ve already said, the SA102 had details of the UK employment income and the tax paid on said income.BoGoF said:

I gave you the answer - complete HS304. You have assumed completing a non-residence page refunds the tax - it doesnt. You dont declare the employment income, you complete HS304 to say you are not declaring it as non-resident and claim the tax back on the non-residence page. You will need a certificate of residence from the ATO. Direct your complaint to your accountant._Penny_Dreadful said:

That’s it in a nutshell. Difficult for HMRC to uphold a complaint when they can only act upon what is (or isn’t) submitted.BoGoF said:

You're welcomeWhy would I not declare the employment income and PAYE already deducted on the SA102? At the time of submitting my tax return I would not have had enough information to submit the HS304 due to the different financial years and my paranoia about how long post takes between the two countries. One HMRC letter took over 5 months to reach me in Australia even though it was supposed to be sent to a tax agent in the UK.The crux of my complaint to HMRC is that the information on the SA302 is incomplete. Refund or not I would like the SA302 for the 2020/21 to correctly reflect the information submitted on all parts of my tax return. Surely before I can try and claim any sort of refund from His Majesty I need HMRC to acknowledge I paid the tax in the first place.0 -
Do you actually have a copy of the paper return that was actually submitted to show that what HMRC have on their system is wrong? If you do and HMRC have not captured the employment page then fair enough BUT getting them to add it in now isn't going to change anything - it's not going to magic up a refund which is the whole aim, no?
You seem to be asking them to add an employment page that you subsequently want to remove via the HS304 process - you don't declare the employment income on your return as you are claiming it's exempt from UK tax under the DTA. HMRC will know what income tax you paid under PAYE.

The refund is the end game and if submitting the HS304 means I don't have to get the SA302 fixed first then that would seem like the path of least resistance. I wasn't sure if HMRC would believe that I have already paid the tax in section 3(a) if there is no record of it on my tax calculation.I have had years of wrangling with HMRC over something else and I just want this resolved. Using an accountant was supposed to help.0 -
Update: HMRC have responded to my complaint. They have acknowledged that I did indeed pay the circa £4,500 income tax. I have received an updated SA302 showing all the income and income tax I paid in the UK 2020/21 tax year. Now I can start the process of claiming a refund.0
