Received a Debt Recovery Plus Letter but no letters before!!

  • Send a complaint NOT AN APPEAL) online to Initial Parking, telling them that the keeper received no PCN, and quote the new bit in the BPA Code of Practice (Feb 2024) that requires them to reissue a PCN, if not received.

    Tell them you suspect that DR Plus are doing all the back office work & letters, and it seems that they only sent a debt demand, which has happened reportedly before, in a case the BPA handled about Smart Parking about 18 months ago.  Smart had to apologise & issue PCNs late.

    Then escalate all this to the BPA.

    DO NOT write that you expect them to be able to prove a PCN was sent because that hands Initial the easy answer 'the Code does not require us to send letters by a trackable service'.  Use my words above.

    Assuming PLAN A doesn't work first.

    So I should try Plan A first? Is that to complain to the retailer? As this car park is not part of any retail, hotel or hospital. To my knowledge, it's just a small car park off a high street that doesn't belong to a certain establishment? It's Wendron Street Car park in Helston, Cornwall if that's any help.

    So does that mean I should send the complaint to Initial Parking first?

    It's also really easy to find, because the BPA provide a version with the changes highlighted in yellow.   I thought you'd look at that one, given I told you it's a new change.

    Yes I now realise that. I had mis-read the request.

    Now that you have pointed out the highlighted version of the new CoP, I have checked again - by reading all the highlighted text.

    Sorry, I can't find it.

    Increasingly I am seeing a reluctance to give straight answers to reasonable questions on this forum.
    Can I suggest @Coupon-mad, that instead giving a reply like 'No that's not it' it would be far more helpful to say "it's paragraph nn.n'?

    I'm not reluctant to give straight answers but sadly, I don't have time to look things up again that I know exist, and it is aways far far better that the OP does that research.  It is defeating the object for us to go looking every week, same as it defeats the object to provide links to info that it is better that a new poster discovers how to locate.

    Half of what we do here is about giving people confidence to use the forum and to research and carefully read typical resources like the Codes of Practice to find the golden nugget that helps their case. Someone on this board used to have this as their signature and I agree with this idea:

    “If you give a man a fish, you feed him for a day. If you teach a man to fish, you feed him for a lifetime.” 

    All I can say is that I read through that new BPA CoP version (skim-reading the yellow highlighted sections only) last week and I spotted it.

    I'm not reluctant to give straight answers but sadly, I don't have time to look things up again that I know exist, and it is aways far far better that the OP does that research.  It is defeating the object for us to go looking every week, same as it defeats the object to provide links to info that it is better that a new poster discovers how to locate.

    Hi guys, 

    So I submitted a complaint to Initial Parking and BPA - Initial parking have just emailed back with a copy of the Parking Charge Notice they apparently sent out to me. It has my correct address on it. It has photos of my car. It also mentions 'Protection of Freedoms Act'

    So what do I do now?

    Dear Sirs,

    I have received your Notice to Keeper _____ for vehicle VRM _____

    This is the first time I have seen this notice. My address is correct, therefore I do not believe you ever sent me the notice to my address. I received no notice at the time I parked, therefore I must receive a notice within 14 days of when I parked.

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to specify the period of parking to which this notice applies as prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    Oh dear  -  had to raise myself from my recuperation bed to point out the obvious anomoly:-
