Fridge freezer failed second time in 2 years

Hello all,

 In May 2022 I bought a Fridge freezer from Currys. It was quite a budget model (£229 at the time; same model is now selling for £309).

 In January last year (2023) the freezer stopped working, I called Currys and they sent an engineer round. The engineer said it would not be cost effective to repair it and Currys gave me a replacement of the same model.

I now find myself in pretty much the same situation, the freezer has packed up yet again. However I am now outside the "1 year manufacturer's warranty," with it now being past a year since both the original purchase and also the delivery of the replacement.

I understand that goods must "last a reasonable length of time," but I'm confused as to how this works alongside the requirement for me to prove that the item was faulty after 6 Months, given I obviously cannot prove that.

  • If you purchase an item, you have any warranty provided by the manufacturer, but you also have consumer protection (Consumer Rights Act 2015) which obligates the seller (Currys). 

    As it's been more than 6 months since the original purchase, Currys may require you to pay for an independent report (a local repair person should be able to give you one for about £50), or to pay for their engineer to come out. 

    As Currys have already been out for the initial fault to attempt a repair/you've had one replacement, i
    f the report says the fault is due to the manufacturing, as opposed to your use or the environment you have it in) then you would be entitled to a partial refund (plus the cost of the report/engineer visit). 

    The refund is based on the expected life expectancy of the appliance minus the time you have had use of the appliance - so if we say the fridge should have lasted 8 years, you've had a working fridge for 2 years, so should get a 75% refund. 
     
    That said, life expectancy is a tricky thing... fridge freezers could be expected to last 5 years or 20 depending on the quality/original price, and Currys will undoubtedly estimate on the low end, so if you can find anything that gives a ballpark it could be useful.
