Letter of administration

My MIL died without a will.  She has 3 grown up children  Can only 1 apply for letter of administration or can all 3 be named on it?
Also, what is needed to apply?
How long does it take roughly?

  • They could do it jointly or if the others are OK with it they could leave one to do it.

Need more information to provide a useful answer to the second question. Size of the estate and her marital status are the most important ones.

Unfortunately the last question is really of the how long is a piece of string question.

You are nowhere near IHT territory anyway but her potential allowance would be £650k -.£1m depending on whether property was held.

Your chances of getting probate quickly massively improve if you do it on line, and get all the documentation right. So it's worth getting someone with a detail head to sort out stuff and delaying a couple of weeks to get it right. Then get the computer confident one to actually do the "techie" stuff, and let the detailer double check the entry.

If you've have not made a mistake, you've made nothing

Tanks for the additional info. For that size of estate there is no IHT return required so you can go straight to applying for letters of administration.

The process can be done on line from the following link. Although it says apply for probate you still use this for letters of adminisration.

  • I did it all myself with the grateful help of many of the people who have posted on this thread. In fact if it wasn’t for this forum and the MSE bereavement page, I would have gone to a solicitor. It is not that complicated, but you do need to get details right. There is no dark art to it that only solicitors and such know!
