Received Claim Form - non-POFA compliant defence question

  • Been a while since I was on here...Yes it was in the name of the family member :-)

We're just doing the N180 and were considering D1 (of the new format of questionnaire)
"Suitability for determination without a hearing"

Maybe I'm not understanding this, but given that we are using "VCS v Edward" as in paragraph 6 further above, and bearing in mind the PCN was sent more than 14 days after the alleged contravention, against the POFA rules, would it actually be better to say Yes?
i.e. no hearing, and therefore no conversation about drivers etc.

Interestingly, the claimant parking company used the old format questionnaire so haven't answered that question.

Sounds like Parking Eye / DCB particulars to me.

    Yes it was DCB.
You won't be surprised to learn that I've never heard of an N279 document  :)  and we never received one.
The confirmation however was from the National Contact Centre for Civil & Family Court and following that, the local court themselves via email after we'd asked for the status.
There is a bit of a backstory to this one - but in short, we had turned up to the hearing on the day only to find that nothing was scheduled and we'd never been notified. After a phone call (I think to the National Centre), they kind of indicated that it was discontinued but said to wait for a letter from the clerk of the court. After a couple of weeks of nothing, I followed up again and got the confirmation I first mentioned above.
We have now emailed asking if they can send a copy of the N279 so fingers crossed and if we get anything then yes we'll redact and pass it on.

Please can you just show us the court email confirming it was discontinued?

    Which parking firm?

Did you not fancy asking for wasted costs, like the NEWBIES thread explains with 2 clear linked examples of how to do that when a discontinuance is very late?

    Here you go (redacted) ...

As for the costs, thanks for mentioning that. I was actually doing this to help a family member so I'll ask if they want to pursue it but it'll be up to them  :)
