Dead iPad

My iPad has died after only 21 months.  Obviously out of one year warranty but surely they should last for longer than this?  What consumer rights do I have in this case?

  • Your consumer rights are with the retailer you purchased from. 

    As it’s more than 6 months from purchase, the onus is on you to show an inherent fault (one that was most likely present when you purchased it). The retailer would be within their rights to ask you to commission an independent report stating a manufacturing fault. You will need to pay for this however can claim it back from the retailer if the report finds in your favour. 

    If a manufacturing fault is identified, the retailer then has the option of repair, replacement (if same model still available) or a partial refund to reflect 21 months use. 
  • In my experience an Apple Store will swap things in the first 24 months.

    That's good to hear, but presumably they only do so if they were the retailer?  There are lots of stories on here of people with Apple products bought from elsewhere who get told by the Apple Store that of course they would replace it if only they'd purchased from them directly...

    Who did you buy it from?

    You need to go back to the retailer and look at claiming under the Consumer Rights Act (and not the warranty).

    If you bought direct from Apple this is usually straightforward. If you bought from elsewhere then you might have to get an independent report showing the fault was inherent.

    What's the cause of death, hardware or software?

    Assuming it's not drowning or death by fizzy drink, is it something that can be repaired?

    Apple will usually repair their devices regardless of where purchased but there's obviously a cost to that.

  • Thanks for all your comments.  I bought it from Apple.  No accidental damage occurred.  It just overheated to the extent I could hardly touch it and has been dead ever since.

  • Phone the nearest Apple Store and make an appointment, it is highly likely they will give you a new iPad of the same model and spec.  I have had this service with 2 iPods and one iPad that basically died of old age, no complaints here.

    Phone the nearest Apple Store and make an appointment, it is highly likely they will give you a new iPad of the same model and spec.  I have had this service with 2 iPods and one iPad that basically died of old age, no complaints here.
    'New to you' perhaps.

    My experience of the genius bar is that they do a few perfunctory tests to ensure the fault is not due to misuse (water damage etc.) then replace it with a refurbished model. Your faulty device will later be repaired and in turn be issued to someone else.

    That is quite reasonable, the service is quick and is what you are entitled to under consumer legislation.

    Exactly this. Depending on the value, the decision may not be made at the store level but sent away to a service depot who do a more rigorous check. Any sign of water damage will invalidate the warranty. iPods have been discontinued for getting on for 24 months, and would be considered low value. iPads are in between in terms of value - some entry level models the store may well have replacements for, but I’d imagine anything other than a base model would require replacement from their distribution network - and likely an inspection from the depot team, which could well find a reason to invalidate the warranty,

    As said by others - this does not remove the rights under CRA - but if there’s water damage or any other user damage (case being bent, broken screen etc) then the argument becomes a lot harder.
