    Hey chuk,

    If this is over several cards have you checked about responsible lending?

    I am currently trying F&Fs with my creditors. I'm in a not dissimilar situation if you swap coercive control for age - there's no chance of me continuing to pay my DMP once my fixed mortgage term finishes.

    I have sent them the standard letter but have explained everything in addition. I have supplied everything they have requested regarding MH, payments to other creditors and SoA and have generally been very complaint. I have offered everyone 23% as that's how much I have. Tesco refused, counteroffering 60% (not affordable), but two others accepted, three are deciding and one hasn't been able to find the CCA. :)

    So yeah, start at 15%.

    Thanks @tigergambit- this is all very helpful. I think I really have a case for disputed debt (I think that’s what it is called) as most of it was run up over a very short period and the circumstances documented with the police/court. But the bank won’t budge and I just want to get this over with now so  fingers crossed that they accept the F+F..

    Hi, so I’m back again. Up all night worrying. 

    @tigergambit thanks for the advice. I’ve agreed F+F with NW at 20% and was over the moon feeling this nightmare finally over. 

    However, now Sainsbury’s bank, who i was told over phone was writing off debt, have now instead sold debt to Link!

    i wrote to them a while back, as I did all creditors,  with all doc evidence of domestic/financial abuse/mental health issues etc and requesting write off. They didn’t respond. So I then followed with call to vulnerable customer dept. Said they’d call me back. Nobody did. I Called back again and was told debt written off and to await confirmation in writing. Have been waiting. Next thing I get a letter saying debt sold to Link!

    This is appalling. I can’t believe Sainsburys bank can act in this way. I’m now feeling sick with panic and worry. What can I do? They obviously don’t give a hoot about me being a vulnerable customer if they’ve acted in this way.

     I’d appreciate some advice on what I should do next. Thank you.

    Sorry @fatbelly I don’t understand.

     I had a credit card debt With Sainsburys bank, wrote to them with all supporting evidence re: financial abuse and issues with mental health and asked for a write off. They didn’t respond so I called them to speak to vulnerable customer team (as they are aware for number of years of abuse) and was told they would call back. They didn’t. So called again and was told debt was written off and they’d confirm in writing. And now I receive a letter instead saying they’ve assigned debt to LC asset 2 who are getting Link Financial to administer on their behalf. 

    Can Sainsbury’s bank do this? And if so what’s my position with Link Financial re: write off due to coerced debt? Most lenders have written off due to the info/evidence provided and I’ve also got a DMHEF completed by my GP but looks like Sainsbury’s totally ignored this and sold the debt after my write off request and evidence had been submitted to them.

    Well done with NW. Make sure you tell other creditors at the appropriate point when you are negotiating F&Fs.

    Regarding Sainsburys, yes this is appalling, but that's banks and I think the supermarket banks are the most hardnosed. I think I would be inclined to submit a Formal Complaint. If you give National Debtline a call they will talk you through this and provide a template. Did you make note of the date and time when they agreed to write off?

    Yes, they pay lip service to vulnerable customers but they don't give a !!!!!!. Bear that in mind when dealing with them. If you get an offer like this again ask them to repeat it and record that.

  • @tigergambit I quite agree! Thanks for pointing me in the direction of National debtline for complaint letters. 

    I guess though now the debt’s been sold there’s nothing Sainsbury’sbank will do even though they’ve behaved in a way which seems contrary to the DA financial code 2021 and FCA guidance - I’ve been looking it up all night (exacerbating my MH issues).  I’ve got a name and email address to complain to at Sainsburysbank from Debtcamel. Might copy the CEO in too for good measure. I do have dates and times of when I corresponded over the phone and they should have transcripts.

    At the end of the day though, LC Asset 2/ Link Financial aren’t going to be inclined to write off a debt that they just purchased are they? Any ideas what I should do with them?

    You can`t blame the call handler, the decision to sell the debt is taken at a much higher level than that, and its not apparent to the call handler that is what has been decided.

    The debt will show on their system as "settled" or "written off" so they were just telling you what the computer told them.

    I agree you appear to have slipped through the net in this instance, and you should send an official written complaint to Sainsbury`s Bank.

    At the very least they should re-call the debt from Link, and look at the matter again.

    At the same time write to Link and explain the circumstances, they may very well either return the account themselves, or choose to take a commercial decision and close the account on the basis of your complaint.
