Notice of intended prosecution - does it apply in this case?

Hi! 

I am new here so apologies if this isn't the right place to post it. 

Would stopping on the hard shoulder be the type of offence that requires an NIP (sent in 14 days) or could I be hearing about it a lot later on in the year?

I am the registered keeper, it wasn't me who did it but would be useful to know especially as it's going to be addressed to me

    Depends why your vehicle stopped on the hard shoulder and if anyone saw you vehicle doing so

    Does it actually matter anyway -- if you receive anything - just name the driver

    It depends.

    Stopping (unnecessarily) on the hard shoulder is an offence under the Motorway Regs, and doesn't require a NIP., so they have six months to start proceeding.

    OTH careless driving does need a NIP.

    I imagine most people could conjure up a reasonable excuse for stopping.  I can't imagine many are prosecuted unless they stopped and set up the BBQ, played ball etc etc

    Its for emergency use only and I imagine the host of cctv cameras available on the network could rapidly unravel a lie
  • The stop was because my husband's contact lense fell out. He started to suffer a dry left eye, rubbed it and the lense fell out. He luckily had a pair of glasses right there, so pulled over and put his glasses on. That's why he is a bit worried as it's not really something we can prove. 
  • Stopped on the hard shoulder last week, Vomit everywhere, 2 bowl fulls.
    Chemo is a !!!!!!.
    I hope cleaning up the mess and emptying the bowl down the nearest drain do not get us a fine.
