Hello i am posting this on behalf of my daughter

She moved out of her flat on the 1st December 2023 and the day before she popped in to our local town to quickly drop of some unwanted items at a charity shop
The car park she parked in is nearby to the shop and she failed to notice the car park was under new management 
On the 4th December she tried to update her Driving licence and V5C to her new address which  to the property she was moving to but  was not on either the DVLA or the Post office database due to the Flats she was moving to was a new development and the Building Developers had not sorted this out
 

On discovering this she first phoned the DVLA explaining the problem and they suggested that she contacted the letting agent to rectify this this, And also not to post her driving licence and  V5C to them as she did not have an active postal address for them to return it to  

She then contacted  the letting agent explaining the problem and they contacted the building developers who then actioned this and the address was only updated on the Post office system which in turn was updated the DVLA system  during the latter part of the week ending Friday the 22nd December 2023

She then updated the change of address on both her car and driving licence

She collected some post from the new tenant of her old flat in late December and some early last week

There were 2 letters in plain envelopes both sent to her old address, one was a PCN with a demand for £60 and if not paid within 14 days would escalate to £100 which was issued and sent to her old address as she was caught parking for 13 minutes by an ANPR camera in the car park 

In the second letter was a demand from a Debt recovery company  for £250  

Not sure how to proceed

    What is the name of the PPC please?

    Where did the alleged event occur? It may have cropped up here before. 
    Get photos of the site and signage.

    Plan A is always a complaint from the keeper to the landowner and the keeper's MP. It is never too late to do so.

    It looks like the appeal deadline has passed, but there is nothing stopping the keeper from appealing by post using the template in blue text that can be found in the sticky thread for NEWBIES, sent unaltered from the keeper. Send it first class from a Post Office counter and make sure to obtain the free proof of posting.
    Be warned though that it is unlikely to be successful, but it is important to engage with the PPC in case a court claim is issued later.

    The PPC is a company called Civil Parking office and their sign says they are members of the BPA
    My Daughter parked there after dark and the car park is unlit as are the signs 
    The letter the company sent was dated the 11th December 2023  (please note I put the wrong year 2022 on my original post) have edited it now
    I expect with the chaos of the Christmas postal service the letter may have take a few days to arrive at her old address
    I know she is beyond the 28 days, not sure how to proceed now, i know we need to contact someone

    Please show us the NTK, both sides, with all personal data redacted, but with dates showing. This will tell us if it is capable of holding the keeper liable. We also need to know where the alleged event occurred.


    CPO is a relatively new company, with only two officers, but hasn't been around long enough to determine if they will become court happy.

    Show us both sides of the PCN and show us this debt demand.

    Needs a complaint to the PPC that they failed to comply with clause 24.4 of the BPA CoP and if they do not address this complaint (treating it also as a dispute/appeal against the parking charge, which only arrived a month late die to moving house) & give her a POPLA Code, she will complain to the BPA about the breach of 24.4.

    Cases cannot go straight from NTK one month, to debt demands the next.  She also requires them to note she has just moved and they must erase the old address, and replace it with the following as the only address for service:
    FULL NEW ADDRESS HERE & POSTCODE.

    DO NOT LET HER ADD ANYTHING THAT ADMITS TO OR IMPLIES WHO WAS DRIVING.

    If they ask who was driving she DOES NOT answer that nor add any reply before checking here.

    But show us both letters (both sides) first.  Leave ALL DATES VISIBLE but cover her data, the PCN number and cover her car details & VRM.

    They are showing the location as Orchard Way, North Crawley MK16 post code
    The alleged offence was at Orchard Street, Crawley, West Sussex RH11 7AE
    Which is around 75 miles away and my Daughter has never been to Milton Keynes



     
    OK that is a POFA-worded NTK so they can potentially hold either the driver or registered keeper liable; except, as you say, the location is wrongly specified and I doubt the signs were adequate.

    Now show us the other letter I asked to see.

    And tell us how the complaint (NOT APPEAL) that I already advised you to make to the PPC is going.
