    I use it a lot. Very easy as long as you always change BEST MATCH to NEWEST.

    I initially thought this was one person's name and that confused me.  Turns out it's two court cases which I have found and looked through the transcripts for, thanks.

    What I'm struggling with is how to apply it to my case and, specifically, my Defence.

    But your search will have found results including the words I wrote for a defence or WS a few months back.  You just copy those words.

    Your post on 12 december, 6:12.

    It relates to a case where it is known and stated that the keeper was not driving.  In my case, the keeper has declined to comment on whether they were driving or not.  I thought that was a significant difference and I'm not sure how to weave your words into that scenario

    I appreciate the help but I do not understand the help that is being given.  Please are you able to link me directly to the specific wording that you say can be copied?  I assure you I am not being lazy, I have looked at this, when I have had time to do so, for days, and I don't get it.  I don't want it to be missing from my defence but equally I don't want to write the wrong thing in my defence or argue it poorly or incorrectly.

    At least one of them, MET Parking Claim Form/Stansted Starbucks..... has this text included if you click on it and read the whole thread: -
    (ii). In April 2023, His Honour Judge Mark Gargan sitting at Teesside Combined Court (on appeal re-claim H0KF6C9C) held in Vehicle Control Services Ltd v Ian Edward that a registered keeper cannot be assumed to have been driving. Nor could any adverse inference be drawn if a keeper is unable or unwilling (or indeed too late, post litigation) to nominate the driver, because the POFA does not invoke any such obligation.  HHJ Gargan concluded at 35.2 and 35.3. "My decision preserves and respects the important general freedom from being required to give information, absent a legal duty upon you to do so; and it is consistent with the appropriate probability analysis whereby simply because somebody is a registered keeper, it does not mean on the balance of probability they were driving on this occasion..." Mr Edward's appeal succeeded, and the Claim was dismissed.

    Jolly good. It is there.  I just looked.

    At least one of those 15 results has not just the wording about Edward but also the wording about Smith.
