CAR INSURANCE QUERY

Hi I wonder if someone can offer me a definitive answer here..

I got 3 points 4 years ago (cu30) which have now been removed according to my licence check 

On my insurance renewal it asks me about last 5 years whether I've had a ything on my licence 

My question is do I have to declare the 3 points?

    Yes. Otherwise if you try to make a claim, and it comes to light, then they'll rightfully not pay out, so you'll have thrown your money down the drain, lost your car, and likely will have your insurance cancelled which you'll have to declare forever resulting in higher premiums for years to come.

    Yes. The length of time that insurers can ask about convictions is governed by the Rehabilitation of Offenders Act, which sets a time period after which a conviction becomes "spent" and no longer has to be declared to insurers, employers etc. For most minor motoring offences the period is set at five years, hence the 5 years in the question.

    This is completely separate to the length of time that the DVLA record the details of the endorsement. If you were convicted of, say, robbery the DVLA would not record the details on your driving licence at all. You would still have to declare the conviction to insurers if they asked (most do have a "do you have any unspent non-motoring convictions?" question).

    We're it not for the Rehabilitation of Offenders Act there would be no reason why an insurance company could not insist that you declare your motoring offences forever.

    4 is less than 5, so yes.

    Indeed. One thing they can (and do) ask about "forever" is if the proposer has ever had a policy cancelled. They can do this because a policy cancellation is not a criminal conviction and so is not covered by the Rehabilitation of Offenders Act.

    The last time I got points it was 6 points in one go.
    Ouch, at the time most insurance companies ignored the first set of points you get.
    So did not affect my policy, From memory I think it went down.
    But 5 years is 5 years, still need to declare them.
  • CU30 = illegally defective tyre.

    Three years for totting-up
    Four years showing on your licence.
    Five years for declaration to insurers.

    The insurers are asking a very specific question.
    You have a simple choice - tell the truth (declare the points), or lie (don't declare the points).
    Remember, too, that they can easily check the answer against your last few years declarations.

    Remember, also, that if you lie to gain a financial advantage (a cheaper premium), that's not only criminal fraud, but is likely to get your policy cancelled if/when the insurer realise. And you're going to have to declare a cancelled policy for life - which will increase your premiums by far more than a four year old CU30.

    Yes, as an insurance contract is one based on trust.
    A lie voids the contract from inception and means that the insurer can cancel the contract when they find out, only pay out what The Law requires, and then pursue you to reclaim their outlay.
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
