CCJ that isn't anything to do with me

I recently discovered that there is a CCJ against my name - I had no knowledge of this and only discovered when I did a credit check - a mobile phone company have taken out a CCJ for money they say I owe but I have never had a Vodafone contract/phone etc
I have tried speaking to them but because I cannot give any of the security answers (because I never opened the account) I am getting no where - it is having a massive impact on my mental health and my credit rating
Any advice on what can be done?

Formal complaint to the business with the details

Ringing is pointless even at the best of times, keep stuff in writing (email or letter - get proof of postage if letter)

People are rich because they spend less money. A poor man buys $10 boots that last a season or two before he's walking in wet shoes and has to buy another pair. A rich man buys $50 boots that are made better and give him 10 years of dry feet. The poor man has spent $100 over those 10 years and still has wet feet.

    Apply for setaside

Any idea why you did not see the claim form?

  • I can only assume it was sent to an old address

If you deny the debt is correct i.e. you genuinely had no contract with them, it would probably be worth the formal complaint before paying for the set aside as you do have to show the CCJ was not correct to avoid wasting your money. Do you think it could be fraud from an old address using your mail for ID purposes or similar?

The only way to remove a judgement, after the initial 30 days, and before the expiry of 6 years, is to apply for a set aside.

A set aside by consent is cheaper, if you can get the company and the court to agree you are not the debtor.
