Private Parking Ticket at Work Premises

Hi All,

I have a strange one for the experts!

My work car park has ANPR enforcement 0800-1730 Monday - Friday.

One day I drove to work and entered at 0750, I left at 0845 to go to a doctors appointment for an hour and then returned at 0955. I worked all day and at about 1500 paid for my day-rate parking by the app that costs £5 flat rate for “day-rate” parking. 

A few weeks later I received a PCN from the private company Open Parking that manages the car park saying I breached condition 32- Non-payment on Exit and had to pay a fine.

I have appealed to no avail and contacted my employer who said they are not willing to delete the PCN and that I have to appeal to IAS.

Any thoughts?

The signs say, “controlled area, by entering you are agreeing to comply with the following;
1. You must clearly display a valid parking permit.
2. You must comply with the conditions of your permit.
3. You must have a valid cashless session.
4. You must be parked fully within a marked bay.
5. You must comply with the direction of any other sign.
6. Don’t park on double yellow lines.
7. Do not obstruct any other vehicles.
8. Vehicles in disabled bays must have a blue badge.

No Where does it state you must pay before exit and it doesn’t explain any further what a “valid cashless session is”

Any help / ideas?

I don’t believe there is any breach of contract from my part as I had paid, albeit after leaving and returning.

    Open Parking is a trading name of Imperial Civil Enforcement Solutions Ltd

    Does your employer own the car park? If not, you need to complain to the landowner and your MP. A landowner cancellation is always the best option.

    If you are a member of a trade union, your rep should be all over this.

    Do not try an IAS appeal unless you have a very, very, very strong case, and you know what you are doing.

    Was the NTK PoFA compliant? If not, did you reveal the driver's identity in your initial appeal?

    Get photos of the site and signage.

    Other than the above, you are now in ignore mode unless you get a letter of/before claim or a court claim.

    Hospital site?  Get the Facilities Manager to cancel it.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
