in Cutting tax
Hi all
My ex employer has told me that they don't keep P60s and a P60 was available to download on their HR portal when I was an employee there (as I left in July 2023, I didn't download one).
Is this correct? I am not sure how to complete my tax return without this as I received taxable benefits.

If they were available electronically and you didn't download a copy then your employer may provide a duplicate but doesn't have to, and in seems like they are not.
Log onto your HMRC personal tax account and you should be able to get your 2022/23 pay and tax details from that. However unless your employer taxed your benefits through the payroll then it's not going to tell you your taxable benefit figure - you should have got a P11d for that.1 -
BoGoF - excellent. I've never looked at my HMRC personal tax account so this is a great time to start, Many thanks as I didn't know how I could complete my tax return otherwise. That's a worry gone!BoGoF said:If they were available electronically and you didn't download a copy then your employer may provide a duplicate but doesn't have to, and in seems like they are not.

They'd have to provide whatever information they held if presented a valid Subject Access Request under data protection legislation, and it sounds highly unlikely to me that an employer would have wiped payroll records relating to the previous tax year less than a year after it had finished, even if the employee left the company....BoGoF said:If they were available electronically and you didn't download a copy then your employer may provide a duplicate but doesn't have to, and in seems like they are not.0 -
Agreed but they are under no obligation to provide a duplicate P60 and doing a SAR isn't going to get the info in time to submit Tax Return.eskbanker said:

Yes, SAR timescales aren't likely to be compatible with the tax return deadline now, but if there's anything OP is unable to source from HMRC via the personal tax account (e.g. benefits info), retrieving it from the employer would seem to be the only option if OP doesn't have copies secured at the time.BoGoF said:

I wasn't suggesting that there's an obligation to regenerate formatted P60 (or P11D) paperwork as such, but if OP needs specific figures then the employer is obliged to divulge those in response to a valid request, unless they were no longer held, which I'd consider unlikely - 'scorched earth' policies for the likes of WhatsApp messages may suit certain politicians but most corporate payroll systems operate to higher standards!2
