  • You asked for the wrong thing.  You will have to ring again.  You can't get the claim form.
    Good afternoon I called and was sent details of the POC which is pretty much saying I breached contract as I needed authorisation to park on the premises and I was captured on ANPR entering and leaving the premises. Should I post the details here? Also take a look at my draft statement above and advise.

THE SIGNAGE CLEARLY DISPLAYED THROUGHOUT ROSEHILL BUSINESS CENTRE, DERBY, ROSEHILL BUSINESS CENTRE, NORMANTON ROAD, DERBY, DE23 6RH STATES THAT THIS IS PRIVATE LAND, MANAGED BY PARKINGEYE LTD, AND THAT IT IS SUBJECT TO TERMS AND CONDITIONS, INCLUDINGAUTHORISATION BEING REQUIRED FOR PARKING, BY WHICH THOSE WHO PARK AGREE TO BE BOUND (THE CONTRACT).     Is THAT the date PE actually stated in the PoC or your typo?

    POC stated it was issued 07/06/2023 the PCN states its issued 10/05/2023.
    I appealed 14/05/2023,they responded with rejection notice 07/06/2023.

    So as part of the defence you can state that it is denied that a parking charge notice was received dated 7/6/2023 and the Particulars of Claim are erroneous.
