Basically.....

Employee gets a company car purchased by the company, they are the V5 keeper

Company get employee to insure the vehicle, in her name, they send the money to her

She is the sole insured driver

4 months later, company dismiss employee

The company car is collected by her boss and driven away

She is instructed NOT to cancel the cover (or policy) as the policy is thier property

She has "family cover" with 2 other cars

What would you suggest/advise?

(P.S. can a vehicle be covered by 2 seperate policies, i thought thats not allowed)

Now we all know how it felt to play in the band on the Titanic...

Cancel policy, return funds to company. She does not want to be insuring a car that is not being driven by her.. Think any claim on that policy is going to mean a claim she will have to declare.

Sounds like a plan by the company to avoid claims & get cheap insurance.

Which is basically the same advice the OP was given in the employment board. Not sure why they thought that wasn't sound advice.

You thought wrong on the last point. It's perfectly possible to have two policies on the same car. In the event of an incident that was covered by both policies, the two insurers would share the cost of the claim.

On the wider point though she should categorically not be insuring a car if she is not in a position to control who drives it. In the event that someone not covered by the policy drove it and caused an accident, her insurer could end up having to pay third party claims, and could then come after her for the costs if they argued that she had showers an uninsured person to drive it, or breached the terms of the policy more generally (did she declare that she didn't own the car?)

The whole arrangement sounds dodgy as hell. I agree, cancel the policy, inform the (ex-) employer that it has been cancelled, offer to return any money refunded.

On the wider point though she should categorically not be insulting a car if she is not in a position to control who drives it.
