Glad you got the CCJ set aside. Of course the CoP doesn't actually specify a 'soft trace' because it's a self-serving code deliberately written vaguely!  That's done to give operators wriggle room in cases just like yours.

She should have seen exactly what it meant if she'd realised this CoP is written by the industry, for the industry.

The new statutory Code (hopefully coming in next year, now that the new MHCLG Ministers are in place) specifically says that a SOFT TRACE is mandatory.  I know because I wrote that bit, effectively, as part of the Govt Steering Group.  It needed spelling out. The Govt listened to me on that.
