ParkingEye charge success - vehicle breakdown

Hi I recently appealed a PCN from ParkingEye for ‘parking’ at a Welcome Break on the M1 whilst broken down awaiting recovery. A few days after doing this I took advice from this Forum and decided to ask WB to get the charge cancelled - although WB website says they don’t intervene, but today they have responded to say they will ask for it to be cancelled.
It was a very distressing incident because recovery and repair took so long due to staff shortages. I was in my car for over 2 hours waiting until quite late in the evening, not sure that constitutes parking!
I hope I am posting in the right section. I just wanted to let people know as I thought it was going to be a long battle to argue with Parkingeye that a PCN is unfair when I couldn’t move the vehicle safely and it was better being there than on the hard shoulder. I didn’t notice any signs about charges - always thought services were free to stop at!! No doubt if WB hadnt intervened P Eye would be harassing me! I sent evidence to both as to what was going on including my hefty recent repair bill! I guess the cameras are automated and it only records arrival and leave times..not what happened in between but it was unpleasant to get PCN after everything else!

PE are generally efficient in writing to confirm the cancellation (7-10 days), but if you want to be ahead of the game, you can check the current status of the PCN by logging into their website, going as if to pay (obviously don't!).Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
