I would be arguing the case that the white line to the right hand side of the car has been extended all the way to the kerb and the driver parked within these markings. If this was not intended to be part of the bay the additional length of white line should not have been painted.

In law if a term or condition can be interpreted in more than one way the interpretation used is the one favouring the consumer.
Yes, that's a reasonable assumption. An end parking bay formed by a solid white line across the back, another one down the right hand side, a kerb at an angle across the front, and a kerb down the left hand side.
In addition there is a random white-ish line half way across the back, and another random white line partly visible at the front, and therefore one that possibly also only goes half way across the bay. Certainly, the line under the front wheel doesn't appear to go all the way to the kerb on the left of the car according to the bottom right thumbnail showing the front of the car.

The Consumer Rights Act 2015 Section 69 applies.

Might even be worth taking this one to the IAS. I think VCS might drop it.

DO NOT ADMIT WHO WAS DRIVING.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Pardon my ignorance, what do you mean take it to the IAS? Instead of appealing with the charge directly?
  • VCS will undoubtedly not agree find any appeal you make in your favour as that earns them zero £ of your hard earned money. But they should then offer an IAS appeal who might agree to your appeal. Bit of a long shot but @Coupon-mad is suggesting in your case it might be worth a go.

Even in the event IAS reject your appeal you should not pay. They are known as a kangaroo court. You have much better prospects of convincing a judge if they are daft enough to pay for a court claim and hearing

    Read the NEWBIES thread please.

No poster should be ignorant to the farce of the two appeals stages.  All is covered.

I see! Thank you, I will work on a bespoke appeal and see what happens.

Thank you all for taking the time to help me, it really is appreciated.
I'll post back with the result!

  • Well done Excremation. Looks like they threw the towel in early and decided they weren’t go to waste any more effort on their silly trumped up attempt at extortion.

Well done. They have failed in court with this type of claim in the past.
