Specific Rules1. The Win with Heart and Netflights On Air Competition promotion (‘Promotion’) is organised by Global (as defined in the General Terms and Conditions). The Promotion will run from Friday 5th January 2024 to Thursday 19th January 2024 on Heart West Midlands. Global is the Promoter. The ‘Promotion Partner’ mentioned in these Specific Rules is Netflights and the ‘Prize Provider’ Netflights.
2. IMPORTANT: The Promotion is subject to these Specific Rules and the General Terms and Conditions which are available here (together, the ‘Promotion Terms and Conditions’). Entry into the Promotion constitutes acceptance of these Specific Rules and the General Terms and Conditions.
Details of the Promotion:
3. To enter the Promotion, you must go online to the Promotion entry page at https://campaign.heart.co.uk/west-midlands-netflights-jan24 and register your details.
4. Online entry will open at 15:00 on Friday 5th January and close at 12:00 on Friday 20th January 2024. Entries received before or after this time will not be included in the Promotion.
5. Each day between Monday 15th January and Friday 19th January 2024 the online entry will temporarily pause at midday, all eligible entries will be entered into a draw. One entry will be selected at random, and the entrant will be contacted by the Heart West Midlands team between 4pm - 7pm the same day via the telephone on the number on which you entered. If the entry is ineligible, we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another entrant, as applicable.
6. If you are this entrant and we call you, your call may be recorded for our records and/or could be broadcast live or later in the show. You may also be asked to have a call with a presenter, during which you may be required to answer a further question or questions or complete a further task(s)]. That call will either be broadcast live or pre-recorded for future broadcast. You must answer your telephone when we contact you. Someone else cannot answer the phone, participate or accept a prize on your behalf. If: (i) you fail to answer the phone; (ii) someone else answers the phone; (iii) the call goes to voicemail; (iv) the call becomes disconnected; (v) you are not (or do not seem to us to be) in a position to safely and/or lawfully take or remain on the call (for example, if you are or seem to be driving); or (vi) you are not audible or intelligible or we are not able to conduct a conversation with you in a manner that is suitable for broadcast for any reason beyond our control (including, but not limited to: low/no signal on your device, a call is dropped by any network, you are travelling, there is too much background noise or feedback, etc.); before or during the Promotion, you may be disqualified and we reserve the right to select another entrant to participate in the Promotion or withdraw the prize and select another winner, as applicable. If you have complied with all applicable terms and conditions, and if you are successful (including correctly answering any questions and/or successfully completing any tasks, as applicable) then you will be declared the winner of the Promotion.
7. The entrant must answer the phone with the following statement: Netflights – Check Me In! If the entrant answers the phone with this exact statement they will win.
8. For the avoidance of doubt, this must be the phrase that the entrant says first, and as soon as they answer the phone. The entrant will also have 5 seconds from the call being answered to say the winning phrase, if the entrant takes longer than this the prize will be forfeited. The producer’s decision is final and we will not be obliged to enter into any correspondence in the event of a dispute.
9. If you do not answer your phone, attempts to call you go to voicemail, you answer the phone without the Winning Phrase or answer with an incorrect version of the Winning Phrase, or the call is terminated as per clause 13, you will not be deemed the winner.
10. For the avoidance of doubt, if we call you, we offer no guarantee of how this will display on your phone. A handset could display a number, it could show ‘unknown’, ‘withheld’, or display in any other way. At our absolute discretion, we may choose not to play every call and call attempt on air.
11. If the first player is unsuccessful, the presenters will then give the opportunity to listeners to text in for their chance to win the prize. Text in with the keyword as directed on air to 82122 (the ‘Text Message Line’).
12. One winner be selected at random from all the eligible entries and will be contacted by the Heart West Midlands Show Producer.
13. The opening and closing times of the Text Message Line will be given out on air. Entries received before or after this time will not be included in the Promotion but may still be charged.
14. We are not responsible for any latency experienced by your mobile phone network, which may delay the delivery of text messages to and/or from us.
15. Text messages will be charged at standard network rates. Standard rate text messages to promotion shortcodes are not normally included in ‘inclusive’ packages and may be charged. If entry is made by text message, be sure to use the correct shortcode. In all cases, please check with your service provider for more details and charges. If you are not the bill payer, you must obtain the bill payer’s permission before entering.
16. Once the first part of the on-air competition has finished, one entrant will have another chance to win £500 only. See further details below. Duplicate winners are not eligible.
17. We and Promotion Partner/Prize Provider may publish and publicise your name and your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Promotion.
18. In relation to winners (and runners up if applicable), you understand that we and our Promotion Partner may: (i) interview you and your guest(s)/travel companion(s) which we may film, photograph and/or record and; (ii) film, photograph and/or record, you and your guest(s)/travel companion(s) in connection with the Promotion, either by telephone or in person, and we may use such films, recordings and/or photographs for publicity and PR purposes in any and all media, worldwide, as often and for as long as we consider appropriate or desirable, in connection with the Promotion. We may also publish your and your guest(s)/travel companion(s) name, image, social media handle and/or profile picture.

19. The Promotion is only open to residents of the UK aged 18 and over, and who are based in the UK at the time of entry.

22. Due to any unforeseen circumstances (flight cancellation, delay, delays, including promotor pre-arranged airport transfers, or overbooked), the winners flight will be rescheduled.
23. Subject to availability the promoter will work with all parties to provide rooms with mobility access if required.
24. Baggage limits are - Ethiopian 23kg, Qatar 23kg, Emirates 25kg, Aer Lingus 23kg & Virgin 23kg. Additional baggage may be purchased at a cost by the customer directly with the airline.
25. The Winner will be notified by the Promoter via email and/or telephone within 7 (seven) working days. The prize will be available to the winner within 30 days of the winner claiming the prize and must be booked within this 30-day time period.
26. It is the prize winner's responsibility to ensure they have a valid passport/visa and travel insurance for their chosen travel arrangements.
27. Flight tickets are valid on specified booking only and are non-extendable, non-transferable, non-re-routable, non-endorsable and non en-cashable and shall at all times be subject to availability and airlines Conditions of Carriage and applicable ticket conditions as set out on the airline's website. The Winner and where applicable their guest must travel together on the same dates/sectors on both outward and return journeys. If a Winner or where applicable the guest is unable to utilize the flights no cash alternative will be provided. All travel documentation and visas must be up to date and are the responsibility of the Winner and where applicable the guest. Flight tickets do not include access to the airport Lounges.
28. Netflights accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by the Winner or where applicable the guest as a result of entering or participating in the Promotion or accepting the Prize. This exclusion does not include any liability for death or personal injury caused solely by the negligence of the Promoter. Participants enter the Promotion at their own risk and agree to indemnify Promoter against all costs, losses, damages, expenses and liabilities (including for loss of reputation and goodwill and professional advisors' fees) and any claim arising from a participant's own actions in any way in connection with the Promotion or a breach of a participant's obligations hereunder.

36. Resort transfers are included. Netflights will include airport transfers for all winners.
37. In the case of disputes, Netflights reserves the right of final decision on the interpretation of these terms and conditions
38. We will endeavour to transfer the prize money to your bank account within 28 days but are not responsible for any delays. You must provide all necessary details via the method directed within 14 days after the original request to do so otherwise the prize will be forfeited at our discretion.
39. You must, at your own cost, comply with all necessary checks, and/or tests required for travelling to and from and entering and exiting your travel destination/venue. This includes, but is not limited to, purchasing, organising, undertaking, recording and/or registering any required Covid-19 tests. We will not be responsible for any costs incurred by you in complying with this clause, nor will we purchase, organise, undertake, record and/or register any required Covid-19 tests.
40. You must comply with all applicable rules, regulations and guidance relating to Covid-19, both in the UK and your travel destination/venue. We are not responsible for your failure to comply with such rules, regulations and guidance.
41. You acknowledge and agree that, without limitation to the provisions of Clause 12 of the General Terms & Conditions, our ability to fulfil a prize and/or perform any of our obligations under the Promotion Terms and Conditions could be affected by an actual or threatened epidemic, pandemic, disease or quarantine and/or any corresponding governmental action, guidance and/or ruling (including but not limited to any Foreign, Commonwealth & Development Office guidance) (collectively ‘Covid Measures’).
42. If due to any Covid Measures, we are unable to fulfil a prize or perform any of our other obligations under the Promotion Terms and Conditions, then we shall not be in breach of the Promotion Terms and Conditions. In accordance with Clause 37 below, in these circumstances, we reserve the right to substitute the prize with another prize of equal or greater value at our absolute discretion.
43. The winner must provide their own Travel Insurance and arrange their own transport to and from the UK based airport.
44. Any other costs and expenses which are not specifically included in the prize description are excluded and will be the sole responsibility of the winner. By way of example, without limitation, Travel Insurance, airport car parking, and Travel to and from the UK airport is not included within the prize.
