Dcbl legal

Hi new to the group but being following the newbies thred as dcbl have sent a letter of claim I replied to it and sars then got this reply via email can anyone help me to what process I need to take  thank you

    Plan A is always a complaint to the landowner and your MP, and it is never too late to do so.

    Which PPC is involved? Group Nexus perhaps?

    Its an SAR, not SARS, which is a serious illness. This is not me being petty. The law is a pedant, so it is very important that you use the correct terminology.

    Other than Plan A, you should get photos of the site and signage. If that is not possible, then see if Google Streetview has any images from around the time of the alleged event.

    Has the driver's details been revealed to the PPC at any point? 

    Do not answer the following questions on the forum, but do think what you would say if a judge asked you.

    Was the car on site for over five hours, or was it two separate shorter visits? If the former, was extra time purchased, or was there some event that prevented the driver from complying with the terms displayed on the signs at the site?
    Can you remember who was driving?



    Read the guide to court written by bargepole that you will find in the second post of the sticky Announcement for NEWBIES in conjunction with the template defence sticky Announcement. That way you will know what to do when a court claim lands on your doormat.

  • Thanks for the reply ur right group nexus is the ppc I’ve only gave details of my name address and postcode as there requested if I sent the email as mentioned  on the newbies thread and no details of the driver has being given also  received poor photo images from nexus how keen are dcb legal to attend in court or are there trying there best To intimidate me into paying the charge  numerous people have used my vehicle in the past I don’t recall ever being at that said location

    Show us the PCN.  Was it POFA worded?

  • Hi I don’t have a pcn as it’s dated over a year ago I can’t remember ever getting a pcn charge just started with the debt recovery companies an now the claim letter which I used the letter denying any debt   as shown on the newbies thread just want to be on the ball with the next step to take  with these an happy to stand at court there extorting motorists any way the can  cheers 
  • Can you just confirm that it's a letter of claim from "DCB Legal" (solicitors) as stated in the title of your thread and not their legally unqualified affiliate "DCBL" stated in your post.  "DCBL" is short for "Direct Collections Bailiffs Ltd" and has no standing to conduct legal proceedings. 

    If it's from DCBL, just ignore it.  If it's from DCB Legal, you could consider replying towards the end of the 30 day time limit to the effect that you deny liability but are taking debt advice anyway.  That will delay the start of legal proceedings by another 30 days, which will give you time to start preparing your Defence because you will know from this forum what a DCB Legal claim form looks like and how to respond to it.

    One thing to be careful about, if you move house before the legal proceedings start, notify Group Nexus, DCBL and DCB Legal of your new address and require them to erase any former address from their records.

    Yes but you have to follow the process to show them they do not have a case that will win in court.  Was the address on your V5C up-to-date and correct at the time of the event?  It is worrying that you didn't receive the original PCN and this is the iusual reason.  PPCs then use a tracing service to find you, send debt collection letters and then revert to your incorrect address to send the N1 claim form.

    Thanks for your reply yes current address up to date I’ve had every letter from recovery agents group nexus but not an original pcn   I’m just waiting for there next  move will i receive a court letter next from dcb legal there have sent over the copy of the pcn from ukpc photos are poor quality I refuse to pay there’s big signs on motorways stating if tired take a break but it’s these people stopping people doing that by using sly tactics to squeeze peoples hard earned money when using any parking facilities

    Yes the court claim will be next and you then just do what it says in the second post of the NEWBIES thread.

    It will not be discontinued straight away but that will happen!  At WS stage. Read the KNOW WHAT HAPPENS WHEN section of the thread
