CCA Request - should I go ahead or not

Afternoon,

Since April this year I have been managing my own debt, previous to this Step Change managed it from June 2019 until March 2023.

Towards the end of 2025 all defaults will be removed from my file, around 11 of them.  If my circumstances don't change its likely that payment will continue even though the files will be removed from my credit report.

I've read on here about requesting the original CCA from the company who purchased the debt, but I'm not sure if its relevant in my case or am i wrong and should request these?

Any advice would be really appreciated.

    You should probably have done this before you commenced on your DMP - but won't hurt to do it now, especially if you are self-managing.  If they can't / couldn't produce the relevant CCAs (quite likely due to time elapsed), you can cease paying.  BiB x

    If it's a Consumer Credit Act debt then it's a right you always have.

    If they can't comply with the request then the debt is unenforceable until they do.

    @f@fatbelly Ive sent emails off and have responses from all companies acknowledging the requests and the accounts are on hold.

    Few questions please:

    1 - if they provide the original CCA, i guess this is enforceable and i continue making the monthly payment as usual.

    2 - how long do they have to come back with the original CCA?

    Statutory time frame is 14 days, but don`t expect to hear anything for a good few months.

    Also it doesn't have to be original CCA, it can be a reconstituted version.

    See what they send you, if anything, and post back.

    don't forget when you write your CCA request you state please supply CCA and  statements and any other relevant documents.

    cos PRA couldn't find statements yet found the cca and deemed it unenforceable.cos of that.

    yet link financial only gave the cca and deemed my request enforceable, and I'm having long standing argument with them cos they never produced statements.
    they promised on phone to send original lender  statements.but never did..
     the only statement was a generic 6 month  repayment statement that came in post last week showing last 6 months from the date they took on the debt and my dmp repayments to them

    they original lender never gave them any historical statements 


    I think is a major part of the CCA request that doesn't get discussed much. cos without statements , it is still unenforceable, as it was part of your legal right to receive them. such as PRA showed and admitted 
    Christians Against Poverty solved my debt problem, when all other debt charities failed. Give them a call !! ( You don't have to be a Christian ! )

  • i had the opposite, they sent me some statements but not the CCA ( i would of thought they could of easily cobbled one together but hey ho),  they never managed to find one in over 6 years so now statute barred :) good luck, hopefully they wont find yours.

    myself and wife got pra statement today in post cos they have to give you one every few months, it shows balance and states this debt is currently unenforceable but still exists

    note, they can't even find my wife's CCA or statement and she opened her Barclaycard account roughly they same time as mines over 11 years ago
