Consumer Rights 30 day start date

Morning all,

Purchased a used car in early December which has been shocking. Finally managed to get it checked and was advised to return it.

Garage says we’re one day out of our 30 day Consumer Rights return period, but that’s from the date of purchase, not the date we actually collected the car.

Does anybody know if the 30 days is date of purchase or date of collection of the vehicle?

It's 30 days from taking ownership.
As I understand it, that means:

If you paid and had it delivered later, it's from delivery.

If you paid a deposit and returned another day to pay in full and collect the car, it's when you paid in full and collected.
(paying a deposit holds the car, it doesn't mean you own it yet, the test would be if they let you take it, which they wouldn't until you paid in full)

If you paid in full and collected the car a week later, it's when you paid in full.

Under the Consumer Rights Act 2015, you have a short-term right to reject your car if it is of unsatisfactory quality, unfit for purpose or not as described. You can get a full refund. However, you should remember that this right is short-term and is only limited to 30 days from the date you bought your car.

There is no short-term right to reject under the Sale of Goods Act 1979.

    Legislation is https://www.legislation.gov.uk/ukpga/2015/15/section/22

30 days commences the day after you have taken ownership and, if relevant, the goods have been delivered... if its on hire purchase or some other form of finance where you are not the owner then ownership changes to possession.
