Full and final/CCA/6 year old default queries.

Hi All,

I am in the process of preparing full and final offers to my creditors, but have some queries that I'm hoping some of you knowledgeable lot can assist with!

Firstly, in my years of lurking I've learnt to not offer full & final settlements without a CCA. I have 2 debts in particular, which was given from Lowell to Overdales, and combined into 1 debt. The original creditors are Shop Direct (Very) & 118 money. Am I correct in thinking that if a debt has been combined, they are unlikely to be able to provide a CCA? This is quite a substantial debt of £5500.

Secondly, there are several accounts that will be dropping off my credit file this month. I intend to CCA these accounts, but asides from this is there anything that needs to be done with these long term?

Lastly, I am going to send CCA requests out, but I am curious if i can do this by emailing the national debt line template, and sending a bank transfer of £1 with the reference number & CCA as the note?

I've got a lump sum of £7k to use, but 25k of debt (20k of this will drop off my credit file by april). £2k of the money will be used to pay a CCJ off that was registered 15th December 2023.

I'm going to sit down and ring various creditors to see what deals can be done. Annoyingly Cabot had sent 70% off deals early in 2023 but I wasn't in the position to take these offers. The last time I checked they wanted 80%, but hopefully I cant swing them round!

    Note - on this debt I had a Letter of Claim sent on 16/10/23 so I am keen to address this, however I do not have access to a printer to send the CCA request.

    Just wanted to wish you well with this. I had some advice from Sourcrates on the F&F thread about 6 months ago and have been trying the same from a very similar financial position.

    When you say 20k will drop off your credit file I'm assuming that you have been paying towards these and they won't become time-barred?

    There are others more capable of answering your questions but my experience so far would be to prepare for a VERY long haul but there are possibilities of resolution there.

    First thing is to get your CCA requests out. Most of my creditors returned the POs and some credited them to the outstanding amount. I therefore see no reason why you shouldn't request these by email - as long as you use the correct template it should be fine I'd think. At least you are likely to get an acknowledgement - I'm still waiting on one from a creditor. 

    Once you've sent these sit tight and await responses. Don't pay any more to creditors until you have had a copy of the CCA. Once you get them you can make pro-rata offers. I have made these as the CCAs have come in - you will get asked for further info and SOA. Up to you what you provide. I have MH difficulties and am nearing retirement so have chosen to play along but it's your choice. 

    Don't expect quick replies, but at the same time be willing to act promptly when opportunities occur. FYI my current state is:

    TESCO - replied quickly with CCA but then ignored F&F for 4 months until I hounded them for a response and they refused without considering it. Undergoing arbitration. Not nice people.

    Moorcroft/Santander - Still to supply CCA. I also have an overdraft with them and they appear to want to deal with both together.

    PRA/Barclaycard: Say they have the CCA but haven't supplied it. DebtCamel suggest that sometimes Banks sell on with the proviso that the buyer can't come back to them for a CCA. Seems strange, but it's been 10 weeks since they promised to provide it and they have acknowledged that it is unenforceable without the CCA. Keeping my fingers crossed on this one. 🤞

    Sainsbury's/ Capital Resolve: CR Wanted lots of info including health info. I am still supplying this (getting health records is a nightmare).

    Pulse (Amazon, Aqua et al.): Heard nothing for 4 months then a phone call after which they provided a CCA within a month. I made my offer (23%) which was accepted 10 days later and settled.😁

    So a mixed bag and it rolls slowly on. I'm not paying anything atm which gives me a stick to use when they call, but it's a long, slow process.

    Thanks for your comment, some great insight there. 

    I’ve made token payments to the debt due to drop off my credit file, but I am going to request CCA’s now. 

    My main aim is to be able to get a mortgage in a couple of years, but not sure how I’d stand with this still having outstanding debts that I’m paying towards, even if it’s not showing on my credit file.
