Lifetime interest

Hi, my dad is currently setting up his POAs and doing his will. He doesn't have a big estate so inheritance tax is not a concern. He says he wants to leave his house to my brother and I but for his partner to live there as long as she wants. This is obviously fine as that's his wish but my brother and I want to make sure that the will / trust are made up in such a way to safeguard his wishes. His partner is not very bright ( I don't mean to be nasty here, she's a lovely person) and we are concerned that without having enough knowledge to set things up properly or ask the solicitor the right questions she could be taken advantage of later. Also can dad express a wish that she only lives there for as long as she can live independently,  no family members or new partners are to move in etc, what about if she fails to maintain the property etc.

    there has to be some agreement about who maintains the property 
  • This is a job for his solicitor to do, it will be a fairly standard thing for them to do.this.

    My mum’s will specified that my stepfather could live in the property (which she owned solely) until he either needed long time care, or died, or cohabited - whichever came first. It also said that he was responsible for the maintenance and insurance of the property.
