    Please see the following for my WS and evidence. This can based on the skeleton WS by VincentVega (link).

    The addition to this example is to argue against the ambiguous language used on the parking site............
    If that is a witness statement this time, you should use "I" not "the defendant" also your statement of truth still states DEFENCE!

    @Le_Kirk Got it I will change that accordingly. Thanks for spotting this. Will proof read the docs again after the edit to ensure I don't miss anything else. 

    I still haven't heard back from PE. The deadline for WS submission is 10/04/2024 at 4 PM. 

    I guess I will push this across tonight and see what happens tomorrow morning.

    If they are not willing to settle out of court, I will just make PE work for their £205 share.

    If needed in due course, when you proof read no doubt you will pick up the following:-

    "The Defendant asks the judge to read the persuasive Judgement from HHJ Judge HHC Murch (August 2023) and deliver the same outcome given this the Claimant filed a similar vague POC. In the Civil Enforcement v Chase case, full costs were awarded to the motorist and the claim was struck out."

    Typos  -  no middle "e" in Judgment (see doc you are exhibiting)

  • Good luck Stephen. I am a newbie here and have also have been shafted by parking eye at Hoults yard Newcastle. In my case I went to Golf Fang and didn't even notice the parking signs as was after 9pm in January and was pitch black and the sign was completely unlit in that part of the car park. I went with a date who travelled separately to me and also got fined so obviously wasn't just me not being observant!

    I will probably create my own thread once I have a bit of time as do not want to detract from your case but will look on with interest.

    Currently at the Tribunal Court now, we will see what happens. 

    Will keep everyone posted. 

    @Victim_of_parking_cowboys I will keep you updated with any relevant information. Apologies to hear that you have fallen victim to the Hoults Yard scheme.

    Should things go unfavourable, what are the baseline claims the Claimant can be based on, I presumed:
    1. £100 of the Parking Charge
    2. Court Fee (Cost) - £35
    3. Legal Fee (Cost) - £50
    4. Witness Travel (Cost) - Not applicable as the Claimant employs a legal rep.?

  • @StephenCNE - How did this end up?

    I have got a PCN from ParkingEye about Hoult's Yard. I filed the initial appeal, which has unsurpringly been rejected, so I move onto the POPLA appeal I suppose. It's ridiculous that we should have to go through this ludicrous process.
