Group Nexus - PCN

Options
I must confess, I’m a newbie to all this. Since receiving a PCN from GroupNexus I have read many forum posts, however, I’m still unsure of the correct course of action given my actions so far. It all started when I returned to my gym after a short hiatus. Unbeknown to me, they had implemented some new parking rules governed my groupnexus in which you have to enter your number plate and select a photo of your car inside the gym. Now of course i was unaware of this, so didn’t enter any information. A couple of weeks pass and I receive a PCN (you guys know the rest) I appealed and explained I’ve been a member of the gym for many years and was genuinely unaware of the new parking rules. I provided evidence, and was thanked for my correspondence. Now the first mistake, they asked for driver details and I handed them over (like taking candy from a baby) mainly due to them making it sound like the PCN would be cancelled. Some time passed and I have just received word my appeal has been denied, and the usual “on this occasion we will accept £20 for costs incurred, and if this is not paid within 14 days the penalty will be charged at the original rate." Now since reading many forum posts I have seen some wording of how to get out of it, although the way I’ve interpreted it is most people wouldn't have already given their details over at this point in the appeal process?! I am planning on finding out who the landowner is and will explain the situation to them, however, is there any other way I can get out of this, perhaps by still appealing to the POPLA with said wording? Thank you for anyone who advises me on this! I hope you all had a great Christmas.

Plan A is always to get the business that hired the parking company to order the parking company to cancel the PCN if they want you to continue using their service. That would be the gym if it’s the gym’s own car park, or the estate management if it’s on a retail park or similar

In case that doesn’t work out in time for the POPLA deadline (which is usually day 33 rather than day 28 as stated in the rejection letter) start working now on your POPLA appeal. POPLA takes the BPA Code of Practice very seriously which you can find here http://www.britishparking.co.uk/write/Documents/AOS/AOS_Code_of_Practice_January_2020_v8(2).pdf

Look for breaches of Section 19 which deals with signage and especially 19.10 which says what they must do in relation to notifying new rules to existing users.

Hi mate, just wanted to say a big thank you. I managed to contact the company that manage the land and it's all been cancelled. Continue doing gods work!
