I give any monies standing to my credit at the date of my death ???????

Hi thee all,

Could anyone clarify, see if I am reading this wording right for me please.

To my Son, I give any monies standing to my credit at the date of my death.

Does that mean all the money this person has goes to the Son?

    Some context would help, but I expect it means the balances of any bank accounts go to the son, yes.

    Where is it from and why are you asking?

    monies (money) has a specific meaning. As above, context would help

    Was this a home made will? You can't avoid taxes by writing this. "Duty's" is spelled wrong and there are no duties on cash. Are you the executor?

    from what you say it seems like all the money the deceased has goes to the son - this would include savings, cash, bank accounts, premium bonds etc

    it would not include goods and chatels for example cars, or land and buildings or indeed shares

    No, made at a solicitor's.

    No I am not the executor, my brother is, he is supposed to shear things, but I dont like it that way. My Father does not now either, and wants me to make a new Wll, and item everything.

    So the other son my brother has ful control of where the moneys will go ???

    I have the shop, and my brother also has a house. Another house is half and half.

    Sorry - this is a bit unclear.
    These are extracts of wording from your father's will? And your father is still alive?
    It's not really possible to interpret what these extracts mean without seeing them in context - i.e. along with the rest of the relevant wording. E.g. how to interpret "my son" when he has more than one son right?
    And someone with more expertise may need to comment on how "monies standing to my credit at the date of my death" should be interpreted. What if bank accounts are in credit at the date of death - but utility bills turn up later. Do they reduce the "monies standing to my credit at the date of my death"? Or to pay them would the executor need to sell physical assets to get some cash.

    Are you saying that, in another section of the will, you are being left a shop and your brother a house plus another house to share? 🤔

    But as @bobster2 says, if your father is still alive and of sound mind then he can go back to a solicitor and write a new will to show his current wishes. I'd suggest that any new will needs to be drawn up very clearly to avoid the confusion you're having with this one.

    I appreciate you might have withdrawn names (rightly so) for posting on here but the current will seems ambiguous unless it says, for example, monies to my son, Jack or whoever.
