Income Protection claim refused

I have an income protection policy for a small amount through British Insurance Protection which I thought would cover my shift allowance should I be off sick. I get full pay of my usual salary minus shift allowance for a period of up to six months. I have just had a two month period of sickness and submitted a claim to BIP. They have refused to pay out on the basis of their policy document stating:
"If you qualify for an Accident or Sickness claim but continue to receive an income from your employment, the monthly benefit will be reduced so that the total gross income received from your Employment and the Benefits payable, does not exceed 50% of Your Gross Monthly Income.
I had a previous policy many years ago which did pay out and wrongly assumed that this policy would be the same. My question is whether or not I would have any grounds for a claim against the policy being mis-sold please?

How did you buy the policy?
If it was via a broker then there is a possible argument for miss-selling if you can show that you asked them explicitly for this.
Not sure who "BIP" are, sounds a little like Towergate's former British Insurance that was a reseller of ASU. Those guys only did direct non-advised sales and so wouldn't have been a case of miss-selling but a case of miss-buying as with non-advised sales its up to you to work out if the policy is suitable for your needs.2 -
If you assumed, it means you didn't read the terms and conditions but you would have signed to say you did,
So miss bought , rather than mids sold

Thanks folks. I bought the policy directy from British Insurance Protection so it seems I mis-bought. Oh well, I've cancelled my DD as the policy clearly doesn't fit what I need.0
