Seller has left lots of rubbish after completion

    Your story reminded me of friends who moved to a croft in NW Scotland. The selller very kindly left them a rake of unexpected items including the (enormous) garden cage her pet skunk lived in. To be fair, it did come in useful when bird flu meant their chickens weren't allowed to roam freely :)

  • It's disheartening but you're tackling it in a very practical way.  Do get in touch with your solicitor to tell them handover was delayed and the house and garden were not left in a fit condition and you expect the seller to compensate you.

    I have moved house 4 times and on every occasion I've left the property I've moved from really clean and in a good condition; every one of the properties I've moved into has needed cleaning before we could start unpacking.  The extent of this has varied but the first house was the worse, the toilet (upstairs) was so dirty that you could smell it from the front door and the garden was overgrown and full of dog sh*t.  However we had 12 very good years there and no regrets.
  • I know you will be better with all this behind you but the vendors are in serious breach of contract not allowing you full access at completion. I would speak to your conveyancers on Monday and tell them that you have had additional expenses (good on you for having an overlap on your rental/purchase but that is for your benefit, not the vendor's).

    I'm not one for chasing compensation but in this case, it is definitely due including the costs you have incurred. Also have a word with the selling agent and tell them how seriously disappointed and inconvenienced you were, although you were not their client, they may give you words of encouragement on how to manage this.

    It's great you got everything sorted, but my gut feeling is this shouldn't be coming out of your pocket, nor should the loss of amenity you suffered by not having your own keys at 3pm on Friday. Don't let anyone fob you off how serious this was.

    You may be correct in what you say but the OP stated they weren't moving in on completion day so in terms of compensation what would they realistically acheive? If they had to pay removal men to wait several hours then yes, there is a sum that can be determined.

    Again, the OP could ask for an amount to cover removal of rubbish/cage etc. but it has to be reasonable and - the most tricky part - they have to actually get the vendors to pay.

    Sometimes it's better just to deal with stuff yourself and move on (the cage and wood will probably earn a few quid on marketplace).
