I'd guess the 40% he stated on the show (without any details) came from a twitter poll, and therefore will have had a huge bias towards those that do not work.
It also wasn't clear if the figure was for those who had had a single problem at one point in time, or those with ongoing issues where the meter was not sending readings (either to the IHD or to the supplier)
EDIT: A google found this from Which, which states from that 23% had had a problem in the previous year, with 41% of those stating the supplier was not receiving readings, and 40% reporting an issue with the IHD.

Could that 9% figure be 9% of all electricity meters, not 9% of all smart meters. Some of which are gas which seem to have a higher failure rate.

That's as reported by suppliers. Since smart meters are "sold" to consumers with the benefit of them being able to monitor their usage and making savings, I'd suggest the consumer impact (IHDs not working) is a better reflection on the success of the rollout.1 -
Update, the Ombudsman bascially said "pfft nothing we can do they say there is a fault somewhere, come back to us in 6 months or so"..
I wrote an email to EDF CEO, had the fault resolved within a week.2
