Missed a PCN Rejection email. Options?

Hi - have read the Newbies thread (thanks, loads of info).

Will try to keep it simple:

Was issued PCN, Appealed via company's online form (and received an acknowledgment of the appeal).

NEVER received a rejection to appeal.

Fast forward and it's now DCBL chasing for a massively inflated amount. Argued that would not pay as the appeal was never dealt with.

Magically, the Parking company (Group Nexus) today forwarded a copy of their rejection (from months ago). So too late to deal with as if it had come now as 28 days have passed.

I have today written to landowner as well to complain just in case it helps.

Options: Can appeal to POPLA now as too late. Can't prove they never sent the rejection (email). Go to court and argue (and per Newbies thread) that the inflated amount is too high? Or just pay it.

Any other options given the circumstances?

    Does it look as if they did email a rejection letter and maybe it went to your junk file?

    Not that it matters.  You'll get a court claim (THE STAGE WHERE YOU DEFEND AND WIN) and a discontinuance will follow later in 2024.

  • No sign of the rejection in the SPAM folder... but of course, it IS possible it went there and was auto-deleted after 30 days. 

    Will be prepping for court claim next!
