Private parking fine, but it is an access road!

Nearly a year ago, I was queuing to enter a car wash, then I was issued a parking fine for being in a queue, on a side road that accesses an eye clinic, sports centre and other amenities and is identified as 'private land and I was parked on this said land!

On my first letter it was identified I had not paid a parking ticket! I have never been issued one. Secondly this is an access side road that takes you as identified above. I appealed but on looking at the reviews to the company you appeal to are in league with one another.

I was issued with a login for 3Dparking to look at the 'proof' photos. On them, yes there are double yellow lines, but in the pictures you can clearly see I am moving, I asked for the subsequent pictures to prove where I was heading but they did not reply to that.  

Now my charge is £240 quid for an unpaid parking charge etc. I was not nor never parked or issued a parking ticket. It turns out the car sales at the corner of the side road has had the sign erected, so potential customers queuing to access them will be fined also.

Any how they are using all of these fancy word etc., you know.....'in breach of'  or 'contractual breach'

So I have gone on the CNBC as I am going to say advised by  [Removed by Forum Team] who is the legal representative and signed this 'claimant' information as fact. I have not been able to speak to anyone as requested or can I log in to the moneyclaim.gov with my super unique claim number...

Any advice would be grateful but regardless they can take me to court and I will represent myself as I am not pondering to these people who think I should be charge for accessing a side road.

Shame on them this is what I say.

    It is not a fine.

    Plan A is always a complaint to the landowner and your MP. It is never too late to do this.,

    Do you have a claim form from the CNBC? If so what is the issue date please?
    Please show us just the particulars of claim without showing any personal data.
    You will need to complete the AoS, but not until day 6 to give you the maximum time to do your research and preparation.

    Follow the guide to court written by bargepole that you will find in the second post of the sticky Announcement for NEWBIES combined with the ready written template defence sticky Announcement that includes a twelve step guide.

    Where did the alleged event occur?
    Get photos of the site and signage, and use Google Streetview where possible to obtain historic images from around the time of the alleged event.

  • Date issue was the 4th December 2023 although I have not heard a thing as they stated since June 2023. Below is what they issued me with...but its not land...its an official side road, access to the aminities...but I was at no time parked up you can see i am nowhere near the kerb, and this is on the pictures they sent me.
  • I would feel aggrieved at the injustice as well. I think most judges will agree that queuing is not parking.

    Don’t ever pick up the phone and talk to any these scammers. They will only try to pressurise you into paying.

    The POC do state the alleged breach, so you need to specifically deny it in your paragraph 3 using the Template Defence.

    Show us your first 4 paragraphs to check.

    With a Claim Issue Date of 4th December, you have until Thursday 28th December to file an Acknowledgment of Service but there is nothing to be gained by delaying it. 
    To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.
    Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 8th January 2024 to file your Defence.
    That's almost four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. 
    To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.
    Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
