Two probate applications at the same time??

My Dad died in September, my Mum died 28 days later. 

Dad left everything (that wasn’t already taken by the care system - grrrrrr) to Mum. His estate includes half of the property Mum lived in. I’m waiting to get the grant of probate now, it was submitted about 6 weeks ago.

Can I submit Mum’s probate application now or do I have to wait until I get the grant of probate for my Dad’s estate?

I'm not certain of the answer so I'm just going to say how sorry I am for your loss. I can't see why you wouldn't be able to submit it now, but I'm no expert.

Yes you can apply for probate for her estate before you are granted probate for his.

You can - but OP needs to be aware that the DWP might start one of its (in)famous and long-running enquiries into their father's benefit claims, if any, which could impact on the value of the mother's estate. If IHT is going to be payable - which sounds unlikely - it might be easier to wait a little while.
