Student rent payments in HMO

My child is one of six students who have signed for a house to rent next year. Apparently the landlord wants rent to come out of one account. I have only ever heard of each student paying their own share from their own accounts (which is what my other children did) so I am a little concerned about this.

Can a landlord insist on this?
I think it would be better to pay individually. Please advise

Was this requirement to pay from one account specified in the contract that was signed? Or that payment had to be made in a way that the LL defined?

It's not unheard of but I can understand the concern - the point is that if it's already been agreed to in the contract then there's not really any get out...

Do they each have their own contract, or is it a single contract for the whole house? If the latter then I suppose the landlord can insist on this, though I don’t know what action the landlord could take if the rent arrived via 6 bank accounts.

My daughter is in a house share for uni & they have to pay one payment of rent. So they have set a simple current account up for the house & they all pay into that one account & pay the rent that way.

While that may be how the account is used it has to be a personal account for one of the people living in the house, so that person is responsible for how the account is managed. It's not likely to be an issue as long as the owner is the only person that pays any money out of the account, but the account will probably be reported to the CRAs so the owner needs to ensure that nothing is done to compromise their record.

The important bit in the contract is "joint and several liability".   If any of the people stop paying their rent they can come after child for the money.     My daughter has just signed for a house next year at uni and I made sure that she is renting an individual room just for her and is not liable for anyone else.
  • This is what my daughter's student house is like. She is 'lead tenant' and the day before the rent is due sends a message on the group chat for the rent, ensures it is all in her account ready to go, it goes out the next day. She sends a screenshot as proof to the group chat.

She didn't want to be the one doing it, but in the end it was just the easiest option after endless discussions about setting up accounts, and she says doing it makes her less anxious of someone else mucking it up!
