Thanks both and yes I will complain too. It's a rubbish system. Sorry KeithP for not reading your messages carefully
I did receive this response almost immediately after 2 attempts to send my defence. Does this reply confirmation count that my defence was successfully received at the right time? All I did was file the defence yet the response mentions that I was unhappy with their service- which i didn't mention.0 -
Standard twaddle we have read about recently; they seem to be assuming that everybody who contacts them is complaining about delays.1

Hi all,
Thanks for all your help so far. It's been almost a year! Since my last message I filled by defence - I have an actual receipt from the ticket machine with my number plate details on it!
I also submitted the N180 Questionnaire form.
Since then BW Legal kept sending me letters to pay up to avoid maybe going to court again and again. Obviously I saw this as baseless threats as I figure I have a pretty robust defence.
However, today I received a letter from BW Legal telling me court has 'Struck out my defence'.
I haven't had any correspondence from the Courts to tell me that my defence has been struck out or why!
Can I even tell if BW Legal are telling the truth?... Is this a dirty tactic of theirs?, Why would they know something that I dont???
Who should I talk to check or where should I go to next?
I have attached the letter below.
Many thanks

Isn't the easiest way to do that to phone the court and ask them the question?2 -
Good point... I'll call the courts. I just don't fathom that my defence would be struck out. I'll report back!0

I've just appealed against a ticket after our parking ticket flipped over at Sennen Beach car park. Despite the fact that I can prove I paid via a picture of the ticket and there is a reference number on the back of the ticket that matches the one on the front that was visible to the attendant they have rejected my appeal, but reduced the cost to £20 from £100, on this occasion. They go on to say that this will not be offered on a future occasion (no fear of us ever giving them any more money to park in one of their car parks!).
I suspect that given they have effectively charged an admin fee (£20 seems a reasonable cost to look at an appeal and draft a letter) that they know they wouldn't win in court and may well possibly not even pursue it that far, but given the cost of my time in engaging in any further correspondence would far exceed £20 I've paid it. I resent it but I think it's a case of learn from it and move on. The stress and time taken in engaging any further with this organisation is just not worth it.
I'm sure that's what they rely on, issuing threats and the fear of further costs accruing and I'm aware that by paying they are making money and I'm encouraging them to continue with their business model, but on reflection I'm cionsidering it a win - they've got virtually nothing out of me and will probably see no profit from this case given the fact they've had to look at and respond to an appeal.0 -
